I won't post the name yet (I will edit/update this if I find out Site Point allows it)

I found some templates of his for sale though site point, but I only wanted one so I contacted him though PM. (August 28th).

Now everything went great, and on Sep. 3, 2006 I sent him payment for the first of the templates, he confirmed payment Sep 3, 2006, at 17:48.

Over time he came up with some excuses, being out of town, etc. He also said several times he didn't have my email, though I included it in Paypal comments and in at least 1 PM before the payment was sent. These all seemed legitimate, and were fine. Sep 6 was the last message I got from him. I made sure to send a PM about every 2 days, he has not sent me the template (I checked the email I gave him, and tested it to make sure it worked before telling it to him again). He has not responded and I know he has seen all my messages since the PM read receipt is confirmed.

He also had the templates back up for auction on Site Point though luckily no on bid during that time.

1. Is there anything I can do? Is waiting 11 with no responses enough to warrantee a Paypal dispute?
2. Is there anything else I should do?

PS. As stated above, can I post the member's name here (public)?
PSS. Is there a better place for this if this forum isn't good?

You can post their name but I'm not sure it'll really get you anywhere. These sorts of posts are pretty frequent. SP don't take any responsibility with regard to non-payment etc (which is fair enough).

Open up a dispute with Paypal.

And Hawk, no, you can't post names. I had a problem with a member here once and the post was removed because they don't allow accusations.

Ah, ok, I stand corrected. I am fairly sure I've read many names in this sort of post, but perhaps I got there before the mods had a chance to remove them.

Anyway, good luck AuroraAlpha, that sort of thing sucks.

K... And its not non-payment, I was buying the template FROM HIM, so its non-product. I will open a paypal dispute tomarrow and then I guess wait 20 days while they work it out.

The best you can do is let us know who the member is so we can make a note about them. If they repeatedly receive complaints against them we may ban them from the marketplace. Otherwise SitePoint does not get involved. Good luck with your chargeback. I suspect you will win.
