PHPNuke now charging why does phpbb allow them to use code
I was wondering that since you must now pay to download php-nuke with the integrated phpbb, why is phpbb allowing this guy to make money off of your work?
I am currently de-nukeing everything I run as phpnuke has seriously went downhill. I hope they do not ruin/spoil the phpbb name while doing so though.

Fb is allowed to charge for the media the product is distributed on. In this case the bandwidth for downloading. He is allowed to charge whatever he wants for that service. Anyone else is free to distribute it as they wish as long as they keep the copyrights inplace in the source code. Not allowing people to redistribute his code is a violation of the gpl he has licenced his software under.

Without wishing to aggravate the situation I'll just say that the GPL is quite clear ... use it to your advantage. I've not checked the current situation but if phpBB is being distributed contrary to the GPL the relevant parties will find themselves in trouble. psoTFX

it seems to me that technically they can ask money for it, but if one person gets it he can lawfully give it to others free. In other words no copyright is truly on it. So just get a bunch of people to pitch in and share the phpnuke between you all. Tadialama

Will people please stop misinterpreting or misunderstanding the term copyright. All works are copyrighted to their original authors in the vast majority of nations on this earth. We are talking licences, not copyrights. psoTFX

FB has "requested" that no one post his code other than PHP-Nuke and is preventing others from being able to do it.
He is trying to turn php-nuke into a cash cow and phpbb with it.
I am not the smartest on legalities, my apologies if I was incorrect. This just feels wrong though.

Erm, no, that's not correct. It is legal because they provide the source code. GPL allows for payment, contrary to popular belief.

Its legal because its time based. You don't actually pay to get it, you pay to get it 1 month before anyone else does. After 30 days or so, its available for anyone to download. Drexion

Not anymore, FB will only release versions to the club, period.
The club was one month but not now.

He considers every release a "minor" release unless it is a 7.0 or whatever now. For example 6.7 (just released) is a minor release and will not be put out at all to any non club members.

You must include a copy of the licence
You must leave all existing copyrights in the source in place and unmodified.
You may not directly append your copyright to ours or try, in any way, shape or form to suggest you "co-wrote" the original source ... you may add your own copyright notice on a seperate line.
You must leave all existing references to the licence intact and unaltered.
You may not relicence any part of phpBB without our express permission (don't bother asking, we won't allow it )
You must clearly note that you have changed the source code. This does not mean dropping a timestamp ID into our header comments. It means a highly visible comment noting that you altered this code and when. The more typical approach is to also include an overview of the changes.
You must include copyright details of source code you have incorporated from third parties, e.g. Mods, images, etc. Remember that not all images, source is released under the GPL and therefore you may be in breach of someone elses licence/copyright if you haven't first obtained permission to use them
You may not force those obtaining your modified work to abide by any additional conditions, i.e. you cannot prevent people redistributing your modified work for free under the GPL.
He has also removed the phpbb copyright line which is very specifically mentioned above that you are supposed to leave it intact and just add yours. trackpads
