Question Daughter has had little bump. ( Overclockers UK Forums Motors )
Updated: 2010-08-18 09:20:25 (29)
Daughter has had little bump.

My daughters had a little bump and broke some fellas back bumper, i want to just pay for this myself as her insurance dosent need any more money adding.

He is off to get a quote iv just spoke to him on the phone.

What i want to know is after iv paid for his repair is that it or is he likely to start whining about whiplash?

Or rather if he starts up with the whiplash bit, can he still claim once i have paid for his repair outside of insurance companies?

Daughter has had little bump.

I'd want him to sign something to state that he's not injured, damages have been paid outside of insurance and he is happy with this outcome etc.

Otherwise he could bend you over at a later date.

Yes, he can easily go via a no win, no fee company to start a personal injury claim.

Ok nice one i'l get the solicitor to draw up something for him to sign.

Once he signs that, its all over though right?

If you have a good solicitor, Yes, it shall be the end! Fingers crossed for you buddy.

There is always the danger that getting him to sign something like that may give him ideas.

Yea! that's it keep the young lady drivers accident statistics off the record

I assume this is the daughter with the Mini? Did it happen at a roundabout? If so be careful, some people move then stop suddenly at roundabouts simply to make a claim on the driver behind.

Depends what sort of guy he is, did your daughter manage to formulate an opinion of him?

Just make sure she gets back out driving and doesn't lose any confidence.

I think you'll be suprised at the cost, what car was he driving, one new door on my Mazda was going to cost ?1400 not including hire car, the other party went straight to her insurance company, when I got quotes one firm had a standard quote procedure as hardly anyone pays out when they realise how much it costs

maccapacca

Surely you could just pay for repairs, then worry about a possible whiplash claim if that comes about... if it does, you can just get your insurance company to deal with that.

Option 1 = pay for the damage, then maybe get insurance involved if there's a later personal injury claim.

Option 2 = get insurance involved straight away. Insurance pays for the damage, and maybe pays out for a personal injury claim that COULD crop up.

For me, option 1 is the sensible option, 'cause there's no benefit to choosing option 2, as it stands. Yes/yes? Not that I know anything about car insurance .

Its the crusty ones you need to watch-out for

If you pay for the damages out of your own pocket I wonder what your position would be legally if the guy made a whiplash claim at a later date.

Would you get done for failing to report and acident to your insurance company, would the insurance company even be interested in the claim?

This sounds good for you/her.

Unless the damage is mega, I don't see him getting it repaired. He'll probably want to pocket the cash, so I'd have thought that a bung of a couple of hundred quid will keep him sweet

I honestly dont know and nor does my solicitor, insurance aint his field.

Im going to buy this bloke a bumper and take him something to sign and hope for the best i think.

Im quite sick of my kids to be honest, between the banger racer and my no work ethic son

DiamondMark

Daughter has had little bump.

Also bare in mind your daughter's policy probably stipulates that you report the accident even if you don't make a claim.

K.C. Leblanc

Daughter has had little bump.

Refuse to pay, its a Mondeo its ment to have tape on its bumpers.

L0rdMike

Aren't you supposed to report it to the insurance, even if you aren't claiming, and he's not claiming off your insurance, and you're paying the costs yourself?

No, you're going to buy him and the lads a round at the local .

I could be wrong, but I just can't see a 'crusty' bloke in an old Mondeo taking Fox Levels of pride in the state of his bodywork.

Any evidence of the crash at all? Any idea if you could just "ignore" it if a Injury-Parasites-4-u type company got involved later down the line? Don't you have to get a doctor note and/or a police statement/report before filing one of these claims?

You mean apart from the phone company's record of his number being on the chap's mobile? I'm not sure 'deny it ever happened' is a wise option!

Robbie G

Is her insurance premium likely to cost another ?300-400 over the next 4-5 years as a result of this accident?

If no, then you might as well just go through the insurance for the peace of mind and protection.

I dont know 17 years old, just passed test 2005 Mini ONE.

Insurance is 2k now.

DiamondMark

I work in the industry so let me know if you need any advice.

If he signs something to say he has been settled in full then you should be fine. Id agree this with him before hand though over the phone or something. wouldn't like to turn up with the bumper and then he refuses to sign the document.

If he signs the document and takes the bumper or whatever then you should be sorted and he wont be able to do a personal injury claim.

I'd be more inclined to offer him cash over the bumper as an added sweetner to the deal. Do this all asap too, if his insurers get word of this they'll want him to do an injury claim and will throw in a hire car etc, meaning you'd end up needing to use your policy.
